Germany - Collective Action Draft Bill

Germany plans to present a draft bill on a collective model case regime (Musterfeststellungsklage) following the sectoral example of its Capital Markets Model Claims Act (Kapitalanleger-Musterverfahrensgesetz, KapMuG). The idea is that designated associations have standing to bring a collective claim and claimants can opt-into such action via a plaintiff registry. Registration would interrupt the statute of limitation and the declaratory judgment in the model case would be binding on all claimants. A brief comment on the draft Bill can be found here.
